Pigeon ("Pigeon," "Pigeon Chat," "the App," "we," "us," or "our") is a messaging application operated by Merandian LLC, a limited liability company. These Terms of Service ("Terms") govern your access to and use of our website at pigeonchatapp.com and our mobile applications (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

Pigeon is not directed to, and is not intended for use by, children.

If you are under the age of digital consent in your jurisdiction (commonly 13–16 depending on location), you may not use Pigeon. By using the Service, you represent and warrant each time you sign in that you meet this requirement and that you agree to these Terms and our Privacy Policy. If we become aware that a user does not meet this requirement, we may delete the account and all associated data without notice.

2. Service limitations

By using Pigeon, you acknowledge and accept the following:

• Content. You are responsible for the content you send.
• Data recovery. If you lose access to your account or device, your message history, files, and chat data may be permanently and irrecoverably lost. The Service is not a guaranteed data recovery service.
• Legal process. Our ability to respond to legal demands is limited to the data described in our Privacy Policy.
• Device and account security. You are responsible for maintaining the security of your device and account.

3. Your account

You are responsible for maintaining the security of your device, your account credentials, and any account recovery materials. You acknowledge that Pigeon is not responsible for any loss, damage, or liability arising from unauthorized access to your account due to your failure to maintain adequate security, and that you may be liable for losses incurred by Merandian LLC or others resulting from such unauthorized access. Notify us promptly if you become aware of unauthorized use, though our ability to investigate or remediate account-level issues may be limited.

You may not create accounts on behalf of others without their explicit consent, or create multiple accounts to circumvent a suspension or termination.

You are responsible for all activity that occurs under your account.

4. Acceptable use

You agree not to use Pigeon to:

• Violate any applicable law or regulation
• Transmit content that is unlawful, such as child sexual abuse material (CSAM), material that facilitates terrorism or violence, or content that infringes intellectual property rights. We may take action against any content or conduct that violates applicable law
• Harass, threaten, stalk, or abuse other users
• Distribute malware, viruses, or other harmful or destructive code
• Attempt to circumvent, disable, or interfere with security features or the intended operation of the Service
• Send unsolicited bulk messaging (spam) or automated messaging
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Attempt to gain unauthorized access to Pigeon's systems, servers, APIs, or infrastructure
• Use automated tools, bots, scrapers, crawlers, or AI agents to access, interact with, or collect data from Pigeon or its infrastructure without our prior written authorization
• Reverse engineer, decompile, disassemble, or attempt to extract source code from the Service or its infrastructure
• Engage in any other activity that could expose Merandian LLC to civil or criminal liability

You are solely responsible for ensuring your use of Pigeon complies with all applicable laws and regulations in your jurisdiction.

We reserve the right to suspend or terminate accounts for violations of these Terms and to pursue legal remedies as appropriate.

5. User-generated content

You retain ownership of the content you send and share through Pigeon. We do not claim any license to your content. Our use of your content is limited to providing and operating the Service as described in our Privacy Policy.

You are solely responsible for the legality of content you send, and for ensuring you have the necessary rights to share any content, including copyrighted material, with your recipients.

Pigeon has no obligation to monitor, review, or enforce compliance with any laws regarding content exchanged between users, and assumes no liability whatsoever for such content. If content is reported to us, we may take action at our sole discretion, up to and including account suspension or termination.

6. Reporting, enforcement, and account termination

Reporting. If you receive content that violates these Terms or applicable law, you may report it by contacting us. When you submit a report, we receive whatever information you choose to share with us. Any review of reported content is discretionary and does not create an obligation to act or an ongoing monitoring duty.

Enforcement. We may suspend or terminate accounts that we believe, in our sole discretion, violate these Terms or applicable law. We may also take action when legally compelled to do so.

Your right to terminate. You may delete your account at any time through the Service. Account deletion removes your account data from our servers in accordance with our Privacy Policy. Upon account deletion, the Service will attempt to delete your messages and files from the devices of members within your chats; however, we cannot guarantee deletion on devices outside our control.

7. Subscriptions and billing

Pigeon offers paid subscription tiers in addition to a free tier. See Pricing for current plans, rates, and features.

• Billing cycle: Paid subscriptions renew automatically on a monthly or annual basis, depending on the plan selected, until cancelled.
• Payment processing: Payments are processed through the applicable app store or our payment processor. Payments are subject to that platform's terms and refund policies, which we do not control.
• Price changes: We may change subscription pricing at any time. For subscriptions managed through an app store, price change notices are governed by that platform's policies. For all other subscriptions, we will make reasonable efforts to notify you before changes take effect. Continued use after a price change takes effect constitutes acceptance of the new pricing.
• Cancellation: You may cancel at any time through your account settings or the relevant app store's subscription management. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial periods, except where required by applicable law.

8. Intellectual property

The Pigeon website and applications, including its design, branding, trademarks, and proprietary software, is owned by Merandian LLC and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in Pigeon's intellectual property.

You may not use Pigeon's name, logo, or trademarks without our prior written consent.

9. Disclaimers and limitation of liability

NO WARRANTIES. PIGEON IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PIGEON WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE SECURITY OF DEVICES, OPERATING SYSTEMS, OR THIRD-PARTY SOFTWARE OUTSIDE OF OUR CONTROL.

NO EMERGENCY SERVICES. PIGEON IS NOT DESIGNED TO SUPPORT AND DOES NOT CARRY EMERGENCY CALLS OR COMMUNICATIONS TO EMERGENCY SERVICES (SUCH AS 911 IN THE UNITED STATES OR 112 IN THE EU). DO NOT RELY ON PIGEON TO CONTACT EMERGENCY SERVICES IN ANY SITUATION.

LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, MERANDIAN LLC AND ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, AND SUCCESSORS IN INTEREST SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, OR LOSS OF GOODWILL; LOSS OF DATA, MESSAGES, OR FILES; DAMAGES ARISING FROM RELIANCE ON THE SERVICE, INABILITY TO USE THE SERVICE, OR INTERRUPTION OF SERVICE; DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; AND LOSSES RESULTING FROM DEVICE LOSS, ACCOUNT ACCESS LOSS, OR KEY LOSS, WHICH WE MAY BE UNABLE TO RECOVER.

RELEASE. YOU RELEASE MERANDIAN LLC AND ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, AND SUCCESSORS IN INTEREST FROM ANY CLAIM, CAUSE OF ACTION, OR DAMAGES ARISING FROM OR RELATING TO THE ACTIONS, CONTENT, OR CONDUCT OF OTHER USERS OR THIRD PARTIES, YOUR INTERACTIONS WITH OTHER USERS, OR ANY DISPUTE BETWEEN YOU AND ANOTHER USER. WE ARE NOT RESPONSIBLE FOR ANY DECISIONS YOU MAKE OR ACTIONS YOU TAKE BASED ON YOUR USE OF PIGEON.

ASSUMPTION OF RISK. YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF PIGEON, INCLUDING ANY RISKS ARISING FROM YOUR INTERACTIONS WITH OTHER USERS, THE LOSS OR COMPROMISE OF YOUR DATA, AND ANY CONSEQUENCES OF YOUR RELIANCE ON THE SERVICE.

CLASS ACTION WAIVER. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF PIGEON WILL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Our total liability for any claim arising from these Terms or your use of Pigeon shall not exceed the greater of the amount you paid us in the twelve (12) months preceding the claim or $100.

FORCE MAJEURE. Merandian LLC shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, cyberattacks, pandemics, or other events of force majeure.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, the above limitations apply to the maximum extent permitted by law.

10. Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS MERANDIAN LLC AND ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, AND SUCCESSORS IN INTEREST FROM AND AGAINST ANY CLAIMS, DAMAGES, LOSSES, LIABILITIES, REGULATORY FINES, PENALTIES, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR RELATED TO: (A) YOUR USE OF PIGEON; (B) YOUR VIOLATION OF THESE TERMS; (C) YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF ANY THIRD PARTY, INCLUDING BUT NOT LIMITED TO CLAIMS ARISING FROM YOUR TRANSMISSION OF UNLAWFUL CONTENT OR USE OF PIGEON IN FURTHERANCE OF ANY ILLEGAL ACTIVITY; (D) CONTENT YOU TRANSMIT THROUGH PIGEON; (E) CLAIMS BROUGHT AGAINST US BY OTHER USERS OF PIGEON AS A RESULT OF YOUR CONDUCT; OR (F) YOUR FAILURE TO MAINTAIN THE SECURITY OF YOUR ACCOUNT OR DEVICE.

You agree to cooperate fully in the defense of any claim covered by this section. You may not settle any claim that would impose any obligation on Merandian LLC or admit any fault on our behalf without our prior written consent.

11. Export controls

Pigeon may be subject to U.S. export control laws, including the Export Administration Regulations (EAR). By using Pigeon, you represent that you are not located in, or a resident or national of, any country subject to U.S. trade embargoes or sanctions, and that you are not on any U.S. government restricted-party list. You agree not to export, re-export, or transfer Pigeon in violation of applicable export control laws.

12. Law enforcement and government requests

We comply with valid legal process. The data available in response to legal process is limited to what is described in our Privacy Policy. We may, but are not obligated to, challenge legal requests we believe to be legally invalid or overly broad.

13. Modifications to these terms

We may revise these Terms from time to time. For material changes, we will make reasonable efforts to notify you, where practicable. Continued use of Pigeon after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, stop using Pigeon and delete your account.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of Virginia, without regard to its conflict-of-laws principles.

Informal resolution. Before initiating arbitration, you agree to contact us using the information at the bottom of this policy and attempt to resolve the dispute informally and in good faith for at least 30 days. If we cannot resolve the dispute informally, either party may then proceed to arbitration.

Binding arbitration. Any dispute, claim, or controversy arising from, or relating to, these Terms or your use of Pigeon that is not resolved through informal resolution will be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), rather than in court - except that either party may bring qualifying claims in small claims court. YOU AND MERANDIAN LLC EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION.

Each party shall bear its own costs and attorneys' fees in any arbitration proceeding, unless the arbitrator determines otherwise.

YOU MUST BRING ANY CLAIM WITHIN ONE (1) YEAR OF THE EVENT GIVING RISE TO THE CLAIM, OR IT IS PERMANENTLY BARRED.

Opt-out. You may opt out of arbitration by sending written notice to us using the contact information at the bottom of this policy within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

15. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Merandian LLC regarding your use of Pigeon, and supersede any prior agreements.

Severability. If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.

Assignment. You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.

Survival. Sections 4 (Acceptable Use), 5 (User-Generated Content), 6 (Reporting, Enforcement, and Account Termination), 9 (Disclaimers and Limitation of Liability), 10 (Indemnification), 14 (Governing Law and Dispute Resolution), and this Section 15 shall survive any termination or expiration of these Terms or your account.

16. Feedback and information

Any feedback you provide through the Service is considered non-confidential, and we may use it without restriction or obligation to you.
